No com\u00e9rcio internacional, essa pr\u00e1tica \u00e9 comum em negocia\u00e7\u00f5es com novos fornecedores, produtos sob encomenda ou quando o fornecedor possui alto poder de barganha.<\/p>\n\n\n\n<p>Embora pare\u00e7a uma transa\u00e7\u00e3o simples, ela envolve riscos log\u00edsticos e exig\u00eancias rigorosas do Banco Central e da Receita Federal que, se negligenciadas, podem gerar multas pesadas.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">1. O Fluxo de C\u00e2mbio e a Natureza da Opera\u00e7\u00e3o<\/h3>\n\n\n\n<p>Diferente das modalidades de &#8220;Pagamento \u00e0 Vista&#8221; (contra documentos) ou &#8220;A Prazo&#8221;, o pagamento antecipado exige que a empresa brasileira possua o numer\u00e1rio dispon\u00edvel para o fechamento de c\u00e2mbio antes da exist\u00eancia do <strong>Conhecimento de Embarque (B\/L ou AWB)<\/strong>.<\/p>\n\n\n\n<p>Ao realizar a remessa, o banco comercial exige o registro do contrato de c\u00e2mbio com o c\u00f3digo de natureza espec\u00edfico para pagamento antecipado. A partir desse momento, inicia-se uma contagem regressiva: o importador tem o compromisso legal de embarcar a mercadoria e nacionaliz\u00e1-la dentro dos prazos regulamentares para evitar que a opera\u00e7\u00e3o seja caracterizada como evas\u00e3o de divisas.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">2. Prazos e Obriga\u00e7\u00f5es junto ao Banco Central<\/h3>\n\n\n\n<p>O Regulamento do Mercado de C\u00e2mbio e Capitais Internacionais (RMCCI) estabelece que a mercadoria deve ser embarcada no exterior em at\u00e9 <strong>180 dias<\/strong> ap\u00f3s a remessa dos fundos. Caso o embarque n\u00e3o ocorra nesse per\u00edodo, o importador deve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Solicitar o retorno dos fundos ao Brasil (repatria\u00e7\u00e3o).<\/li>\n\n\n\n<li>Ou solicitar a prorroga\u00e7\u00e3o do prazo, justificando o atraso (ex: atraso na produ\u00e7\u00e3o ou problemas log\u00edsticos globais).<\/li>\n<\/ul>\n\n\n\n<p><strong>Risco:<\/strong> Se o dinheiro sair do Brasil e a mercadoria nunca chegar ou n\u00e3o houver a baixa da opera\u00e7\u00e3o no Siscomex, a empresa pode ser autuada e ter seu <strong>Radar Siscomex<\/strong> suspenso para averigua\u00e7\u00e3o de fraude cambial.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">3. Gest\u00e3o de Riscos: A Garantia do Fornecedor<\/h3>\n\n\n\n<p>O maior risco do pagamento antecipado \u00e9 a inadimpl\u00eancia do exportador. Ap\u00f3s receber o valor total, o fornecedor pode atrasar a produ\u00e7\u00e3o ou enviar produtos fora das especifica\u00e7\u00f5es t\u00e9cnicas.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Solu\u00e7\u00e3o de Compliance:<\/strong> Em opera\u00e7\u00f5es de alto valor, \u00e9 recomend\u00e1vel exigir do fornecedor um <strong>Advance Payment Bond<\/strong> (uma garantia banc\u00e1ria internacional). Caso o fornecedor n\u00e3o entregue a mercadoria, o banco do exportador devolve o dinheiro ao importador brasileiro.<\/li>\n\n\n\n<li><strong>Inspe\u00e7\u00e3o Pr\u00e9-Embarque:<\/strong> Condicionar a remessa final (ou o aceite do pedido) a uma inspe\u00e7\u00e3o de qualidade realizada por terceiros (<em>SGS<\/em>, <em>Bureau Veritas<\/em>) para garantir que o dinheiro pago corresponda ao produto fabricado.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">4. Vincula\u00e7\u00e3o na DUIMP e Valora\u00e7\u00e3o Aduaneira<\/h3>\n\n\n\n<p>No momento do registro da <strong>DUIMP<\/strong>, o importador deve informar a modalidade de pagamento. Se houve antecipa\u00e7\u00e3o, \u00e9 preciso estar atento \u00e0 <strong>Valora\u00e7\u00e3o Aduaneira<\/strong>.<\/p>\n\n\n\n<p>Se o pagamento foi feito meses antes da chegada da carga e houve uma varia\u00e7\u00e3o cambial dr\u00e1stica, o valor aduaneiro (base de c\u00e1lculo dos impostos) deve refletir a taxa de c\u00e2mbio da data do registro da DUIMP, e n\u00e3o a taxa do dia em que o dinheiro foi enviado. Erros nesse c\u00e1lculo podem levar a autua\u00e7\u00f5es por recolhimento de impostos a menor.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">5. O Papel do Ingl\u00eas T\u00e9cnico na Negocia\u00e7\u00e3o<\/h3>\n\n\n\n<p>Negociar um <em>Advance Payment<\/em> exige precis\u00e3o nos termos de contrato.
