No entanto, detectar o problema na origem (pr\u00e9-embarque) \u00e9, na verdade, uma oportunidade de evitar custos astron\u00f4micos com frete de retorno, multas alfandeg\u00e1rias e, claro, a insatisfa\u00e7\u00e3o do cliente final.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aqui est\u00e1 um roteiro t\u00e9cnico de como agir com precis\u00e3o quando a carga \u00e9 danificada antes do embarque:<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">1. Documenta\u00e7\u00e3o Imediata e Evid\u00eancias Fotogr\u00e1ficas<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O primeiro passo \u00e9 <strong>paralisar o processo de estufagem ou carregamento<\/strong>. Se a carga j\u00e1 estiver no terminal, ela deve ser segregada.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fotos de todos os \u00e2ngulos:<\/strong> Registre n\u00e3o apenas o dano, mas o estado geral da embalagem, o lacre do cont\u00eainer (se aplic\u00e1vel) e as etiquetas de identifica\u00e7\u00e3o.<\/li>\n\n\n\n<li><strong>Relat\u00f3rio de Vistoria (Survey Report):<\/strong> Dependendo da gravidade e do valor da mercadoria, \u00e9 recomend\u00e1vel contratar um vistoriador independente (<strong>Surveyor<\/strong>) para emitir um laudo t\u00e9cnico oficial. Esse documento \u00e9 a pe\u00e7a-chave para qualquer reclama\u00e7\u00e3o de seguro ou disputa com o fornecedor.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. Notifica\u00e7\u00e3o Formal \u00e0s Partes Envolvidas<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Voc\u00ea deve enviar uma notifica\u00e7\u00e3o imediata por escrito (e-mail) para todos os parceiros log\u00edsticos envolvidos no trecho pr\u00e9-embarque:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Fornecedor (Shipper):<\/strong> Para verificar se a avaria ocorreu na sa\u00edda da f\u00e1brica.<\/li>\n\n\n\n<li><strong>Transportador Rodovi\u00e1rio:<\/strong> Se o dano foi identificado na chegada ao porto\/aeroporto, o transportador local pode ser o respons\u00e1vel.<\/li>\n\n\n\n<li><strong>Agente de Carga\/Armador:<\/strong> Para cancelar ou suspender o <strong>Booking<\/strong> e evitar cobran\u00e7as de <em>dead freight<\/em> (frete morto).<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Tomada de Decis\u00e3o: Reparar, Substituir ou Seguir?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Com o laudo em m\u00e3os, o gestor de Comex tem tr\u00eas caminhos principais:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><strong>Substitui\u00e7\u00e3o Total (Replacement):<\/strong> \u00c9 a op\u00e7\u00e3o mais segura para manter a qualidade, mas exige um novo prazo de produ\u00e7\u00e3o e, possivelmente, uma nova <strong>Invoice<\/strong> para refletir os novos itens.<\/li>\n\n\n\n<li><strong>Reparo na Origem:<\/strong> Se o dano for apenas na embalagem externa e o produto estiver intacto, pode-se autorizar o recondicionamento (<em>re-packing<\/em>) no pr\u00f3prio terminal, desde que acompanhado por vistoria.<\/li>\n\n\n\n<li><strong>Embarque com &#8220;Letter of Indemnity&#8221; (LOI):<\/strong> Em casos de danos superficiais que n\u00e3o afetam a funcionalidade, o importador pode aceitar a carga mediante uma carta de indeniza\u00e7\u00e3o onde o fornecedor assume a responsabilidade por descontos futuros ou garantias estendidas.<\/li>\n<\/ol>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Impacto nos Seguros e Incoterms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Verifique imediatamente quem det\u00e9m o risco da opera\u00e7\u00e3o naquele momento, de acordo com o <strong>Incoterm<\/strong> negociado.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Em um termo <strong>EXW<\/strong>, o risco j\u00e1 \u00e9 do comprador desde a f\u00e1brica.<\/li>\n\n\n\n<li>Em um termo <strong>FOB<\/strong>, o risco s\u00f3 passa para o comprador ap\u00f3s a carga transpor a amurada do navio. Portanto, se a avaria ocorreu no p\u00e1tio do porto antes do carregamento, a responsabilidade t\u00e9cnica e financeira ainda \u00e9 do exportador.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Dica de ouro:<\/strong> Nunca aceite um conhecimento de embarque (<strong>Bill of Lading<\/strong>) com ressalvas de avaria (<em>Dirty BL<\/em>). Isso pode impedir o fechamento de c\u00e2mbio e a cobertura do seguro.
